We will be gathering evidence for the Human Rights Inquiry using a number of methods. One of these is to commission research on specific areas that we have identified will help with the inquiry.

Literature review

We have commissioned the London Metropolitan University and Global Partners and Associates to carry out a literature review on the evidence available with regard to the implementation of the Human Rights Act in England, Scotland and Wales and to advise the inquiry on how to progress its work.

We are now looking to commission research into three specific areas of human rights.

Project 1 - Evaluating the impact of selected cases under the Human Rights Act on public service provision

The Aims of this project are to:

  • Identify key human rights cases from the UK and European Court of Human Rights case law
  • Explore the impact of the outcome of a number of strategic legal cases brought under the Human Rights Act and against the UK in the European Court of Human Rights on a range of public authorities
  • Explore with service providers from different sectors whether and how the principles established in these cases have been incorporated into policy, practice and awareness and attitudes of staff
  • Explore the positive impact within these sectors of implementing human rights principles
  • Identify the barriers that prevent or obstruct the use of human rights principles in these sectors.

Project 2 - The impact of human rights culture on public sector organisations: the lessons of good practice

The Aims of this project are to:

  • Identify good practice in public authorities in relation to embedding a human rights culture
  • Identify the steps taken on the journey to embed that human rights culture
  • Assess the positive impact and benefits of using human rights approaches on organisations, service delivery, customers and staff
  • Identify key lessons in developing a human rights culture and how those lessons can be shared with other organisations

Project 3 - The role and experience of inspection and complaints bodies in promoting human rights standards in public services

The Aims of this project are to:

  • Explore the role and experience of inspection and complaints bodies in relation to human rights practices, and how these have implications for the organisations under their remit
  • Establish whether and how inspection and complaints bodies themselves are building human rights principles into their inspection framework, and explore the benefit of a using human rights approach in their work
  • Identify good practice in sectors within the scope of the various inspection and complaints.
  • Share experience between inspection and complaints bodies in England and Wales, of using human rights principles as a framework.
  • Understand how the inspection and complaints bodies engage with the service users in order to shape the principles and methodology of inspection.
